Haryana has no jurisdiction to grant time once there is violation of environmental norms, it said. The State is bound by the Public Trust Doctrine to enforce environment norms as such safeguards are part of fundamental right of citizens to life. Once it is so, the State has no discretion to waive compliance only on the plea of avoiding litigation, said a bench headed by NGT Chairperson Justice A K Goel.
Out of 58 such stone crushers, 10 have been closed. 39 are now complying and out of remaining seven, five have been ordered to be closed while proceedings for closure are pending against two. It is also mentioned that the Government of Haryana has passed an order on May 19 granting extension of time to stone crushers not meeting the siting criteria, the SPCB said.
The direction had come on a plea moved by the Sardar Patel Jan Chetna Education Society that sought enforcement of an October 31, 2018 NGT order, directing the Director of Environment to take steps and specify the distance of stone crushers from educational institutions.
The plea had said that there is no prohibition against setting up of stone crushers near educational institutions which results in violation of the Noise Pollution (Regulation and Control) Rules, 2000 (as amended in 2017).
"According to the applicant, the Mines and Geology Department of the State of Haryana has issued Notification dated September 28, 1992 notifying 'Haryana Regulation and Control of Crusher Rules, 1992'. Rule 3 (5) of the Noise Pollution Rules provides for 100 meters area around educational institutions and hospitals being declared as silence area."
"The said distance has been now increased to 250 metres vide Notification dated September 25, 2017. There is also requirement for precautions for protection of forest, water bodies, health treatment units etc. Some of the States have issued notifications laying down distance from educational institutions within which no stone crusher can be set up," the plea had said.

A number of such stone crushing units have been operating along NH-53 from Chandikhole Inspection bungalow to Chadeidhara. They are mostly run at Ranibandh, Bhadanga, Aruha, Padkhara, Barada and Baulamala.

As per a directive of the High Court linked to the case (WPC9101/2009) and the directive of the National Human Rights Commission linked to the case (134-18/5/0708), it was decided to close all these stone crushing units. Acting on the directive of the HC and NHRC, 147, these units were sealed while electricity connections to them were snapped.
But mega crushing units such as Aruni, RKD, Simplex, Madhab, Garuda, ARSS, Nagarjun, Rocksand, Joda, Tapti, Godagaon, Konark, Jain, Amit and South East had been spared. The owners of these sealed unit expressed their displeasure over it.
As thousands of people depend on these units, the district administration assured them to consider relocating these units at suitable places. The process to identify land for rehab of these units has been initiated.
As per the sitting criteria, no stone crushing units will be allowed to operate within 500 meters from an educational institution, human settlements, health centres and offices. Besides, no stone crushers will be set up within 200-meter distance from state or national highways.

The Cabinet also decided to give 10 per cent additional assistance to women falling in one, more or all categories, such as widow, disabled, deserted and old-aged. Earlier, a woman could be eligible for only one category for pension. Besides, a fund would be set up for providing assistance to women.
In another decision, the Cabinet raised the annual income from Rs 12,000 to Rs 44,500 for families of students who belong to the OBC category and were eligible for governments pre-matric scholarship scheme.
Further, heeding the public demand for setting up a rehabilitation centre for the mentally-ill, who are often found wandering in streets, the Cabinet approved land at Selaqui for setting up a ashram. An NGO is likely to run the ashram.
